If desired, any operator of a formal establishment may be authorized to store supplies or other material for use at the establishment on a long term basis in lieu of a storage warehouse in the establishment which meets the requirements of this subchapter. Such storage, if authorized, shall be kept separate and apart from any other material or supplies, so as not to be confused, or to be used as a source of supplies or other material shall not be regarded as a warehouse or storage, within the meaning of this section, and shall be under inspection only upon the same basis and for the same purposes as other material or supplies, and no inference shall be drawn as to the character or qualities of such storage as to warrant the use of a certificate issued to the operator for any storage.

It is a misdemeanor to transport any article from one establishment to another not approved by the collector under the provisions of this subchapter, or to knowingly transport any such article in commerce or delivery in interstate or foreign commerce for which no inspection shall have been made, or to move or transport any such article against the provisions of this subchapter unless the Commissioner has given written notice or warning to the person moving or transporting the article that such article is not authorized to be moved, or transported in commerce, by reason of which the person moving or transporting the article knows that such article is not authorized to be moved or transported in commerce.

This section shall be enforced by the department of commerce as set forth in chapter 319 and by the United States customs officers and inspectors, and, notwithstanding any other law or detail of the Uniform Commercial Code, by any other Federal or State official, or any local director at the direction of the Director of the Bureau of Customs, as in this subchapter provided.

The circuit supervisor shall notify the chief examiner and the board as to any labeling being used at the establishment, and the board shall fix the penalties and publish the record of the conviction. d2c66b5586
